Does the Residential Properties (First-hand Sales) Ordinance (the Ordinance) apply to all types of first-hand residential properties?

Generally speaking, the sales of almost all of the first-hand residential properties being offered for sale by a developer to the general public will fall under the scope of the Ordinance, including uncompleted and completed first-hand residential properties and regardless of whether they are under the Lands Department’s Consent Scheme or not.

Does the Ordinance apply to the sale of first-hand car parking space in a residential development?

The sale of first-hand car parking space in a residential development is not subject to the regulation of the Ordinance.


That said, vendors are required under the Ordinance to set out in the sales brochure the floor plans of the car parking spaces in the development, including the location and the number of parking spaces; the dimensions and area of each of the parking space. Also, vendors are required to set out in the register of transactions the description of the parking space if it is sold together with a residential property.
